A Wanganui man who performed sexual acts on his wife, who was in a advanced state of dementia, as two other men looked on has escaped a jail term.
The 60-year-old man, who was granted permanent name suppression, had pleaded guilty to exploitative sexual connection with a woman with a significant impairment.
Supported in court by his family and church pastor, he also pleaded guilty to attempting to have exploitative sexual connection with his wife of 40 years, through sexual intercourse.
Justice Warwick Gendall sentenced him to one year's home detention, after prosecutor Andrew Cameron asked for a starting point of four to six years' jail.
The man had been his wife's sole caregiver for 10 years, the Wanganui Chronicle reported.
In April 2006 he invited a bisexual male friend, who he said had had prior sexual relations with his wife, to join him.
The friend brought a third man. After they watched a pornographic video together, the man performed sex acts on his wife.
The third man was unhappy at what he saw and complained to police, saying he had never seen anything "so bad".
"It was obvious to him your wife was severely handicapped," Justice Gendall said.
When interviewed, the man said Alzheimer's literature encouraged the continuation of sexual relations for as long as possible.
While his wife was not able to give consent, he could tell if she was uncomfortable.
Justice Gendall said a psychiatric assessment had shown his wife was "incoherent", unable to recognise people, and showed anxiety or fear when undressed.
Justice Gendall rejected the man's claim his wife had taken part in such activities prior to her dementia and would have consented if she had been of sound mind.
"The bottom line is this is not sexual activity in the permitted sense, but sexual maltreatment and exploitation," he said.
The man did not appear to have genuine remorse or understand what he had done was wrong, and had had sex with her again in the rest home last October while on bail.
He gave the man credit for his previously "blameless" life, his long marriage and long-term care for his wife and his guilty plea.
